Privacy Notice – Personal and Learning Support
About us and this privacy notice
This privacy notice relates to the information you share with the Construction Industry Training Board (CITB) when you discuss any additional support needs you require for your studies, or any other aspect of your attendance at college.
CITB is the controller of the personal data being collected about you.
CITB’s address is Sand Martin House, Bittern Way, Peterborough, PE2 8TY and it is registered with the Information Commissioner’s Office (ICO) as a data controller (number Z7125297).

The personal data we collect
We will collect information from you relating to the assistance you require and, in some cases, why assistance is needed. For example, where we are required to ask clarification questions or for evidence of your adjustment, such as if you need additional time for exams.
How we collect and use your personal data
We collect your personal data directly from you and ask for your explicit consent when we collect any special category personal data from you.
We may also be provided with information from the college you attend in relation to the support you require and how it is being implemented.
Your personal data will be used to:
- Assess your learning support needs
- Record your learning support needs
- Share information with CITB Safeguarding Services (if required)
- Share information with your assigned Apprenticeship Development Officer (ADO) or Technical Apprenticeship Officer (TAO)
- Share information with college learning support staff to enable support services to be offered
- Share information with your employer at your request
Our lawful basis for using the data is that doing so is necessary for us to comply with the law. The specific laws are the Education (Additional Support for Learning) (Scotland) Act 2004 and Equality Act 2010.
In order to provide you with the necessary support, the personal data you provide will likely include special category data. Special categories of personal data include (but are not limited to):
- racial or ethnic origin
- religious or philosophical beliefs
- genetic data or biometric data
- data concerning health or
- data concerning a person’s sex life or sexual orientation
Our legal basis for using special category personal data is that you have provided explicit consent to enable us to do so.
If you were to withhold your personal information we may not be able to provide you with the personal and/or learning support that you require.
Sharing your personal data
We have a responsibility to pass limited details of approved support measures onto relevant third parties, on a need-to-know basis, in order to provide efficient support services and fulfil our legal obligations under the Equality Act 2010.
This processing may include using the data to offer and provide support and assistance as appropriate in line with the Equality Act. Use of the data is also necessary for a matter of substantial public interest, being identifying and keeping under review the existence or absence of equality of opportunity or treatment.
Third parties with which your personal data may be shared include:
- Basic and Key Skills Builder (BKSB) Screening Assessment (online screening service); and
- Cognassist (Cognitive Diversity Screening test).
We use both of these assessment tools to identify specific learning support needs and produce support plans. Further information can be found about each of these third parties at:

Your personal data will not be sent outside of the UK or the European Union as part of our processing.
The processing of your data does not involve automated decision making (i.e. decisions being made about you by a computer, without human review).
Your data will be retained for the length of your course, plus six years.
Your rights
You have the right to:
- Request access to any personal data we hold about you
- Withdraw any consents you have given where we rely on explicit consent for processing your personal data
- Ask us to correct any inaccurate or incomplete information we have about you
- Ask us to delete your personal data from our records
- Ask us to send a copy of your information to a third party in a data portable format
- Challenge any automated decisions (as applicable).
We will deal with your request in accordance with the applicable Data Protection Legislation.
